Turn 2 Sports Photography, LLC Terms & Conditions Effective Date: April 21, 2026 · Last Updated: April 21, 2026 Please read these Terms and Conditions carefully before placing an order with Turn 2 Sports Photography, LLC. By submitting an order form or using our services, you agree to be bound by these terms. 1. Services Turn 2 Sports Photography, LLC ("Turn 2," "we," "us," or "our") provides youth sports photography services including team and individual portrait sessions, digital gallery delivery, and print fulfillment for schools, recreational leagues, and tournaments in the DFW Metroplex and surrounding areas. 2. Orders and Payment All orders are placed through our online order form powered by Cognitoforms. Payment is processed securely through Stripe at the time of order submission. Prices are listed at the time of order and are subject to change for future events. Orders are confirmed upon successful payment processing. A coupon code may be required at checkout for pre-paid packages. Failure to enter the required coupon code at checkout will result in an additional charge. Turn 2 is not responsible for duplicate charges resulting from failure to apply a provided coupon code. 3. Refund Policy All sales are final. Due to the custom nature of photography services, we do not offer refunds once a photo session has been completed and a gallery has been delivered. If you experience a technical issue accessing your gallery or believe there is an error with your order, please contact us within 30 days of gallery delivery at stephen@turn2sportsphotography.com and we will work to resolve the issue. 4. Gallery Delivery and Access Digital galleries are delivered via Pixieset to the email address provided at the time of order. Private gallery links may also be sent via SMS to the phone number provided. Gallery links are private and intended for the individual customer only. Please do not share your private gallery link publicly. Galleries remain accessible for a minimum of 90 days from the delivery date. Turn 2 is not responsible for galleries that expire due to inactivity beyond this period. It is the customer's responsibility to download and save their digital files before the gallery expires. 5. Print Orders and Fulfillment Print orders placed through your gallery are fulfilled through our print partner. Shipping charges apply where selected. Local pickup orders will be coordinated through your team coach or a designated pickup event. Turn 2 is not responsible for delays caused by shipping carriers or circumstances outside our control. 6. Photo Session Policies Players must be present and ready at their scheduled time slot. Turn 2 is not responsible for missed sessions due to late arrival. Retakes are not guaranteed and are offered at the discretion of Turn 2 based on schedule availability. Weather or venue-related cancellations will be communicated as soon as possible and rescheduled at Turn 2's discretion. 7. SMS Communications By providing your phone number, you consent to receive SMS text messages from Turn 2 Sports Photography regarding your order and gallery. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance. We use Twilio to deliver SMS notifications. We do not sell or share your phone number with third parties for marketing purposes. 8. Intellectual Property and Photo Usage Turn 2 Sports Photography retains copyright ownership of all photographs taken during our sessions. Customers are granted a personal, non-commercial license to use their purchased digital images for personal use including printing, sharing, and display. Customers may not resell, redistribute, or use images for commercial purposes without written permission from Turn 2 Sports Photography. Turn 2 reserves the right to use photographs for portfolio, marketing, and promotional purposes unless a written opt-out request is submitted prior to the photo session. 9. Limitation of Liability Turn 2 Sports Photography's liability to any customer shall not exceed the amount paid by that customer for the applicable order. We are not liable for indirect, incidental, or consequential damages of any kind. In the event of equipment failure, unforeseen circumstances, or events beyond our control that prevent session completion, our liability is limited to a full refund of the order amount. 10. Governing Law These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from these terms shall be resolved in the courts of Kaufman County, Texas. 11. Changes to These Terms We reserve the right to update these Terms and Conditions at any time. Updated terms will be posted at www.turn2sportsphotography.com with a revised effective date. 12.
